Driving under the influence or DUI covers many different laws in the California Vehicle Code.   Under the influence can be from Alcohol, Marijuana, Medications or Illegal Drugs; anything that can impair your driving.  The DMV can also conduct a separate hearing, from the court, on your Drivers License suspension.  

When you drive on a California road you are deemed by law to consent to a chemical test upon arrest for a DUI.  Failure to comply with the tests is considered a Refusal and can result in a 1 year minimum Drivers License Suspension with no restricted or IID exception availability.  

Under the influence levels have only been determined by law for Alcohol (Ethanol), and the rest are subject to debate.  DUI’s are predicated on the police having probable cause to stop you, in the first place, which is also a topic for debate.

 In California, a unchecked DUI can result in jail time, DUI classes, substantial fines, drivers license suspension, and in some counties an Ignition Interlock Device.  Additionally, if you work in a County or State regulated occupational field then it will have possible  implications/penalties there also.  That why people hire me.

Driving Under the influence or DUI

I have been a California Attorney since 1997 mainly in Criminal Defense.   Starting at the Office of the Los Angeles County Public Defender then worked for two major statewide DUI firms and two major statewide full criminal defense firms. I have appeared in County Courts in both the top,  bottom and most of the Countys in-between California.

I would say my usual approach in most criminal cases is to start off with a softball approach. I  get to know the prosecutors, their strengths, what they think they have on you, and try and work out a deal that works for you. If it doesn't, then we switch to a hard ball approach. I ask for all sorts of informal discovery. access to evidence, and any justifiable motion towards a dismissal or reduction in charges, then if that doesn't work, we get ready and go to trial.  The majority of cases get solved in the Softball phase, since trials and juries bring a certain amount of risk and increases in costs and penalties. Discussing your options and costs, risks before you hire a lawyer is my recommended advise to you.

The various code booktitle abbreviations are listed below and are in alphabetical order in the list.  Remember that some charges are considered Wobblers, meaning that the charge can be a Felony or Misdemeanor depending on certain criteria.  It is recommended that you consult with an California Criminal Attorney to fully understand the charges, penalties, and the possible defenses.  The impact of your case will be very fact specific and can differ greatly from other similar sounding cases.

​Probation Termination /Expungements (Dismissals)

PROBATION TERMINATION - If you are on probation and cannot get a job or are applying for jobs and keep getting turned down because of more qualified candidates, you being on probation may be the problem.  If it is and you have completed all the requirements (terms) of your probation, you may be able to get it terminated early.  Note: Usually courts like your probation to be at least half way completed, but it is still possible even then.  There are also crimes which by law do not allow early termination.  In today world, it is definitely no slam dunk.  That’s why you need an attorney like me to fight for it..  

EXPUNGEMENTS/DISMISSALS - Today expungements are called dismissals and actually appear on your California criminal record as a dimissal after a conviction,  once the motion has been approved..  At the Federal Level,  expungements/dismissals are generally not recognized.  How it effects you depends on the level of access employers have to your records.  DMV records are also not expungable.   In light of all this, an expungement may hide your record or show you made the effort to clean it up.  I can take care of it.
